TERMS & CONDITIONS
Your bid constitutes a legally binding contract.
By bidding with Jeffrey S. Evans & Associates, Inc. either directly or through another online auction provider (e.g. Live Auctioneers), you are agreeing to abide by all associated auction terms.
1. The auctioneer reserves the right to reopen bidding on a sold lot (under extreme circumstances only) and is the sole determinant concerning all bid disputes. The auctioneer is the final authority in regard to all auction terms and conditions.
2. All auction lots sold are subject to a buyer's premium.
3. In addition to the buyer's premium, a 3% online transaction fee applies to:
- Any lot won by "live" Internet bidding
- Any lot won by Internet absentee bidding through an online auction provider other than jeffreysevans.com/Auction Flex (e.g. Live Auctioneers)
4. Unless exempted by law, all purchases are subject to a 5% VA state sales tax (this is also applicable to out-of-state buyers who pick up their purchases in Virginia.
5. VA law requires that all dealers must have a valid, signed VA Department of Taxation Sales and Use Tax Certificate of Exemption on file with us (required per auction for non-Virginia dealers).
6. Regarding ABSENTEE and TELEPHONE BIDDING directly with our auction house (non-Live Auctioneers):
- Absentee and Telephone bidding is offered as a courtesy, at no additional cost to the bidder. We are not responsible for errors or unexecuted absentee or telephone bids. Our online absentee bidding is powered by Auction Flex. No online transaction fee is imposed on lots won by online absentee bidding through jeffreysevans.com/Auction Flex.
- Your bid is a legal, binding contract. By bidding in our auction, you agree to abide by all associated auction terms and conditions.
- Non-Internet bids: If you do not have Internet access, you may fax, mail, or hand-deliver bids to us and we will enter the bids on your behalf. Non-Internet bids must include the auction date and a signed statement indicating that you accept all terms and conditions of the auction. Note: Your local library may provide Internet access for free, or for a nominal fee.
- All absentee bids must be in written form. We cannot accept verbal absentee bids. Submitted bids that are not commensurate with our standard bid increments will be rounded UP to the correct bid increment.
- Make sure that you have the correct lot number for your item. If you bid on the incorrect lot and win, you will be held liable for payment. When we enter bids for you, we use lot numbers only (we will not verify lot numbers with item descriptions). If we do notice a discrepancy between a lot number and item description on one or more of your submitted bids, we will attempt to contact you to confirm. If it is not possible to confirm your intent, we will not execute your bid(s).
- Absentee bidders may be in competition with various "live" bidders. "Live" bidders may include "floor" or "in-house" bidders (bidding in person at our auction gallery), Internet bidders (bidding in real time via computer) or telephone bidders (bidding in real time via telephone).
- All absentee bids are processed competitively with other absentee bids. In the event of identical absentee bids, the earliest received takes priority. Note: This is only coordinated between two tied absentee bids, and not between an absentee bid and a "live" bid, therefore it is possible that a "live" bidder could win a lot for the same bid amount you placed prior to the auction (it depends on where that bid increment falls during live bidding on the lot).
- Absentee bids placed in person at our gallery are accepted at any time prior to the sale of the item.
- The deadline for all other absentee bids (Internet, mailed and faxed bids) is 2 hours prior to the start of the auction.
- All Telephone bids are subject to a minimum opening bid of $250 per lot and must be arranged by 12:00 p.m. Eastern time, the day prior to the auction.
- We will notify all successful bidders by email or phone (or fax if preferred) within 2 business days of the end of the auction (e.g. by end of day Tuesday following a Saturday sale). Invoices will include instructions regarding payment, shipping, etc.
- Successful bidders should contact us within 6 business days of the close of the auction to make payment and shipping or pick up arrangements. Our office hours
- Payment of your won lot(s) is due within 5 business days of the date of your invoice. If you request our packing/shipping service, payment in full is due within 5 business days of the date of your final invoice. Such requests for packing/shipping must be made within 6 business days of the close of the auction. You may send a check for your purchases after receipt of your initial invoice, and then pay the shipping costs with Visa® or MasterCard® once packing is completed.
- Any special payment arrangements must be pre-approved by an authorized representative of Jeffrey S. Evans & Associates. Such arrangements must be requested in writing, and authorization must be obtained prior to bidding.

7. Once an item is sold to an in-house bidder, the buyer assumes full risk and responsibility for said item.
8. Items purchased in person at our gallery must be paid in full on the date of sale, unless other arrangements have been pre-approved by an authorized representative of Jeffrey S. Evans & Associates.
9. Each returned check is subject to a $50.00 service charge.
10. Accounts that are unpaid after 30 days of the sale date will be subject to a 2% monthly finance charge.
11. The buyer is liable for all fees/costs associated with the collection of balances due, including attorney's fees.
12. Unless prior arrangements have been made with us, any merchandise not removed within 2 weeks of the sale date will be subject to a storage fee. Any merchandise not removed within 60 days of the sale date will be considered abandoned.
13. REFUNDS will be given at the sole discretion of the auctioneer and will only be considered on lots that are determined not to be authentic or have major damage or significant restorations/repairs that were not outlined in the condition report. Lots cataloged without circa dates are not guaranteed as to age. Additionally,
- Refunds in regard to condition for items purchased in person at the gallery must be requested before those items are removed from the gallery.
- Requests for refunds in regard to authenticity must be received within 25 days of the sale. The request must include at least one supporting written and signed statement from an authority recognized by the auctioneer. Note: Your timeliness and type of payment (uncertified checks must clear before we ship) directly affect the time allowed for a refund transaction.
- Absolutely no refunds will be made after 25 days of the sale date.
- Do not return any item until a refund authorization has been obtained from Jeffrey S. Evans & Associates.
14. Additional conditions of sale will apply, as noted on our website and/or as announced by the auctioneer prior to the auction.
15. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the Commonwealth of Virginia.
GLASS & LIGHTING
- All catalog descriptions are guaranteed to be accurate in the matter of authenticity, condition and measurements unless otherwise noted in the catalog description. Measurements are guaranteed to be accurate to within one inch.
- Due to the high number of absentee bids that we execute, we are very meticulous in our description of the condition of each piece. Many of the minor flaws that we note are perfectly acceptable and do not detract from the item's desirability or value; however we do not consider light wear, small manufacturing flaws, glass impurities or lightly tinted glass to be notable flaws.
- If you are a bidder who demands flawlessness, it is recommended that you examine the item(s) in person, or have a trusted representative inspect the item(s) on your behalf.
- Lamps are measured to the top of the collar and are without burners and chimneys unless otherwise noted.
ANTIQUES, AMERICANA & DECORATIVE ARTS
- All catalog descriptions are believed to be accurate in the matter of authenticity and condition, but ultimately all lots are sold "as is." Antiques, by their very nature, will exhibit wear, minor losses and breaks, and small repairs commensurate with age. We only note condition issues that in our opinion significantly affect the integrity of the item. Returns will only be considered for items found to be fake/reproduction and/or have significant damage/restoration not noted in the catalog description.
- If you are a bidder who demands flawlessness, it is recommended that you examine the item(s) in person, or have a trusted representative inspect the item(s) on your behalf.
- All measurements are approximate. Please contact us if you require exact measurements.
- All rugs are sold strictly "as is" with no guarantees as to age or condition. Absolutely no refunds will be considered on rugs.
- Fine jewelry is guaranteed only regarding gold content and authenticity of diamonds. Authenticity of other stones and grades of any stones are not guaranteed.
ALL AUCTIONS
- All requests for additional information will be accepted until 24 hours prior to the start of the auction.
- The auctioneer reserves the right to make verbal corrections and provide additional information from the auction block at the time of sale. Absentee bids will not be executed on lots found to be other than as described in the catalog unless one of our representatives has personally conveyed the updated catalog description to the absentee bidder. The bidder will then have the option to alter or cancel the original absentee bid.
The "hammer price" is the last bid price accepted by the auctioneer for a lot. The buyer's premium, a percentage added to each hammer price, is payable to the auction house by the winning bidder.
Our buyer's premium is 17%, discounted to 15% for cash or check purchases. This discount does NOT apply to any lots won by "live" or absentee bidding through Live Auctioneers.
Our post-auction results or "prices realized" always include the 15% buyer's premium.
A reserve is the confidential minimum price under which the lot will not be sold. Nearly all of our auction lots are sold without reserve.
Any lot carrying a reserve will be identified with an "R" immediately following the auction estimate.
The reserve will never exceed the lot's low estimate.
Following is our standard bid increment guide, which is subject to the auctioneer's discretion.
All bids should be submitted in accordance with this guide:
$0 to $200: $10 raise
$200 to $500: $25 raise
$500 to $1,000: $50 raise
$1,000 to $3,000: $100 raise
$3,000 to $5,000: $250 raise
$5,000 to $10,000: $500 raise
$10,000 to $30,000: $1,000 raise
$30,000 to $50,000: $2,500 raise
$50,000 to $100,000: $5,000 raise
Over $100,000: $10,000 raise
The auctioneer will not accept cut bids (a bid amount less than the stated bid increment).
